Common Q & A for this action

Q: How are the 'no contact' notary visits taking place?

A:
A board member, and a notary will come to your house.
The notary will need to see your state issued ID, but you can hold it up to your glass door, she does not need to touch it.
The notary needs to witness you signing the form, so please do not sign ahead of time.
You will sign the form using your own pen.

You will then slide the form out the door to the notary, and it will be recorded.
Nothing will be handed back to you, so there is no possibility of any germs being passed to you.

You can download the form from our website, and we will have extra forms with us on the day of the visit.


Q: Did the HOA board seek legalguidance on the issue of Phase I expiring?

A: Yes, the board hired real estateattorney Aaron Smeal to look at all the existing documents to determine what couldbe done to align all three Phases with the ‘into perpetuity’ expiration.


Q: What happens if I do not vote?

A: If you DO NOT vote, just like inany election, your vote will not count. If the amendment does not pass you will still owe your dues.  It is important for you to understand, thathomes in Phase 1 will no longer have governing Covenants.  You are still considered part of theHomeowners’ Association, but the HOA will lose the power to enforce covenantsin Phase 1.

 

Q: Who do I call when my neighborsweeds get too tall?  If they leave theirgarbage cans out for days?  If they areparking their car in the grass?   If theyhave a vehicle on blocks in their driveway being worked on for weeks?  If they let their siding fall off theirhouse?

A: No one!  If we don’t pass the amendment, the HOA nolonger has the authority to remedy these issues.

 

Q: Why do our signatures need to benotarized?

A: This is per real estate law.  The covenants are a legally bindingcontract.  Your signature will not bevalid unless you have a notarized signature.


Q: Do all owners of our property need to have signatures notarized?

A: Per real estate law, only 1 ownersignature per property must be notarized. You are allowed to do all signatures.

 

Q: Why doesn’t this pertain to Phase 2and 3?

A: When the developer legalized thisparcel of land and established the HOA, Phase 1
     had an expiration date of thirtyyears. Phase 2 and 3 continued ‘into perpetuity’.

 

Q: How many homes does this effect?

A: We have 215 lots in Phase 1.

Q: How many participating propertiesdo we need?
A:  We must have 75% of phase 1home owners approve for the amendment to be legally bound.  If this does not pass before April 17stwe must then have 100% of home owners.
